We Solve Problems.

Were You Arrested For DWI in Mesquite?

It's not easy to go through being arrested for DWI in Mesquite. For one, it's a very shaking experience. It's also one that can be costly.

If someone is arrested with a BAC over .08%, they run the real risk of being arrested for DWI, and DWI is a crime with stiff penalties.

The state of Texas and the government of Dallas County will ride down hard on DWI sentences, and that is why Michael & Associates works hard to help clients. The stakes are so high that it is a must for you to have someone by your side.

DWI Arrests are Incredibly Costly

Just because Mesquite sees dozens of DWI arrests every month, you might mistakenly think that the price won't be high if you lose your case.

Guess again.

The price you pay if convicted is high:

First Offense:

  • As much as a $2000 fine
  • Between 3 and 180 days in jail
  • Loss of driver's license for up to a year

Second Offense:

  • As much as a $2000 fine
  • Between one and twelve months in jail
  • Loss of driver's license for up to two years

Third Offense:

  • As much as a $10,000 fine
  • From two to ten years in prison
  • Loss of driver's license for up to two years
  • Felony on your record

The penalties only go up from here. If you are caught with an underage passenger or cause property damage, there are enhancements to your sentence if you are convicted.

Don't Risk Your Future For One Mistake

That's not the only price. If you are convicted your license may be revoked or suspended. You might see a hike in your insurance rates, and you also could lose your job.

It's vital that you find professional help to navigate the process. Don't try to do this by yourself.

You need an experienced legal representative to show you the ropes. t it alone.  Be certain to go with a competent, experienced lawyer who knows the system in the area and gets results.

Driving While Intoxicated in Mesquite

In Mesquite, Dallas County, and elsewhere in Texas, any drivers who are stopped with a BAC reading of 0.08% or above are likely to be charged with DWI.  The law is clear that BAC is an accepted measurement of alcohol in a driver's system.

The number of drinks you had, plus your age, weight, and sex are contributing factors to whether or not you are above the legal limit.

In Mesquite, the sentences will reflect your prior record:

1st Offense

  • As high as a $2,000 fine
  • Up to 180 days in jail if convicted, with three mandatory days
  • Suspension of driver's license for up to a year

2nd Offense

  • As high as a $4,000 fine
  • 1 month to 1 year in jail
  • Suspension of driver's license for up to two years

3rd Offense

  • As high as a $10,000 fine
  • Two to ten years in prison
  • Suspension of driver's license for up to two years

Additional penalties will apply if driving with an underage rider, such as:

  • As high as a $10,000
  • As high as two years in jail
  • An additional 180 days of driver's license suspension

For starters, pull over immediately and safely.  Do not attempt to evade the police as you will likely fail to outrun them and will face further charges.

When the officer comes up to your window, just roll it down and remain polite. The officer will want your paperwork, including your insurance and driver's license. Tell the officer exactly where the items are located before you reach for each one.

Police will often ask you if you know why you were pulled over. Simply reply that you do not know. Admitting guilt establishes evidence against you in court. This removes the ability of your lawyer to argue against the charges you face.

You have the right to refuse any test the officer requests of you, and if you're unlikely to pass the exams, you probably should refuse them, politely. Respectfully tell the police that taking any exams without speaking to your attorney first is not something you can do. Keep in mind you're on video, so don't behave poorly or act angry while the bodycam is running.

People get arrested if the officer detects any speech slurring, bloodshot eyes, or the smell of alcohol. Best tests are usually requested to establish your BAC. If you refuse the test there will be an immediate suspension of your license. The reality is that your license would be suspended anyway in case you are found guilty. Your lawyer can help you fight either outcome

The officer can force you to take a blood test, but it will take some time to get the process started.

Remember to remain silent during any questioning they want to do, then talk to your attorney the very first chance you have.

It is almost always better to put up a fight to defend yourself. There is no upside to a guilty plea. Just be sure to find the best lawyer you can to represent your interests.
