Charge
DWI - First Offense
Location
Bexar County, CCL1
Allegations
Officers arrested our client for DWI after a single vehicle incident that damaged a roadside sign. The file included field sobriety testing, a breath result just over the legal limit, and statements indicating alcohol use. We reviewed the video and reports, documented what was and was not supported, and built mitigation around the client's clean record and cooperation. In talks with the prosecutor, we pushed for a non intoxication resolution. The charge was reduced to obstruction of a highway with deferred probation.

DWI - First Offense

Allegations
After a caller reported possible impaired driving in a neighborhood, the client was stopped. The officer noted an odor of alcohol but said the client passed field tests, which were also complicated by knee and hip issues. We secured the reports and prepared to challenge the basis for the stop, the reliability of the third-party tip, and the testing. While we pressed the case, the state failed to file in a timely manner. We moved for dismissal due to delay, and the court granted it, closing the case.

Felony Motion to Revoke Probation
Location
Bexar County, 207th District Court
Allegations
While on felony probation for a prior DWI, our client moved out of state after receiving approval to transfer supervision. Soon after, that approval was rescinded due to an administrative error and the client was ordered to report back within an unrealistic window, which he could not meet. A warrant issued and he was extradited with no new charges. We gathered the probation email trail, filed for bond, and met with the court liaison and prosecutor. Demonstrating the violation was not willful, the state dismissed the motion to revoke and the case was dismissed.

DWI - First Offense
Location
Bexar County, CCL 15
Allegations
There was a minor single-vehicle crash into a neighborhood fence, and officers arrived to investigate. The client admitted to drinking, completed field sobriety tests, was arrested, and later gave a breath sample at the jail that read 0.16. We obtained the police reports and discovery, scrutinized how the roadside testing was conducted, and noted that no roadside breath test was given. We highlighted the short window between last consumption and the station test and challenged proof of impairment at the time of driving. The state dismissed the case.

Charge
DWI with Child Passenger
Location
Bexar County, DC379
Allegations
Stopped for alleged swerving with a child in the car, the client admitted to limited drinking and agreed to a blood draw. The officer skipped most standardized field tests, relying on HGN and simple recitations before making the arrest. We dissected the stop, the sparse sobriety procedures, and the circumstances in the vehicle, and pressed the State on whether they could prove impairment beyond the admission. Using the weaknesses in the investigation and the client's clean record, we negotiated a reduction to a misdemeanor with straight probation.

DWI - Second Offense
Location
Bexar County, CC4
Allegations
Stopped for an expired registration sticker, the client was accused of slurred speech and asked to perform field sobriety tests. After admitting to having a couple of drinks, they refused a breath test and officers obtained a warrant for a blood draw. We secured the patrol videos, reports, and warrant documents, challenged how the roadside tests were administered and scored, and questioned aspects of the warrant process. Leveraging those issues in negotiations, we pushed back on a second-offense filing and the charges were reduced.

Bexar County, Criminal, District Court
Allegations
We obtained discovery and scrutinized every piece of the state's proof, from the intoxication evidence to the enhancement allegations based on prior convictions. We pressed for video, calibration and certification records, and documents linking the priors to our client, and found material gaps and inconsistencies. We set the case for contested hearings and made clear we were ready for trial. With their key issues exposed and admissibility in doubt, the prosecution dismissed the case.

DWI - Second Offense
Location
Bexar County, CCL 14
Allegations
After a night out at a couple of bars, the client was stopped by police with no crash and was arrested. The reason for the stop was unclear, and the client only remembered parts of the roadside tests. They agreed to a breath test but did not know the reported number. With prior DWI history, the stakes were high. We requested discovery and scrutinized the basis for the stop, the officer's instructions during the field tests, and the breath testing procedures. We pressed these issues with the prosecution and prepared to litigate. The state dismissed the case.

Charge
DWI - First Offense
Location
Bexar County, CCL1
Allegations
Following a traffic stop triggered by a third-party call about a minor sideswipe, the client was arrested. They reported memory gaps from a night out, consented to a blood draw, and did not recall field sobriety testing. We obtained the police reports, reviewed available video, and examined the lab paperwork. We pressed the state on the limited officer observations and their reliance on a witness report to establish impairment. With those weaknesses highlighted, we negotiated a reduction to a lesser offense.

Allegations
Stopped for speeding, the client admitted to drinking, performed field sobriety tests, and provided a breath sample before being arrested for a first offense DWI. We obtained the police report and testing records and closely examined the justification for the stop, how the sobriety tests were conducted, and the handling of the breath evidence. We used those issues to push for a resolution without a conviction. The prosecution agreed to deferred probation, keeping a final conviction off the client's record.

Allegations
The client was stopped after turning the wrong way on a one-way street and admitted to having drinks earlier. During field sobriety testing, the officer added a memory-and-recall task that was nonstandard. At the station, the client attempted a breath test but was labeled uncooperative. We attacked the reliability of the field tests and the unclear breath-test procedure, highlighting confusion and poor instructions. After sustained negotiations, the charge was reduced to a lesser offense with deferred probation.
