Driving While Intoxicated in Schertz

In Schertz, Guadalupe County, and the rest of Texas, anyone who is driving a vehicle and caught with a BAC of 0.08% or higher can face a DWI charge. BAC is a measurement of the percentage of your blood that is currently made up of alcohol.

There is no magic formula for ensuring that your BAC stays low which is why DWI cases are so common. It can depend on your weight, height, how many drinks you've had, and how strong each of those drinks were among other factors.

In Schertz, the penalties for driving while intoxicated vary based on how many offenses you have had in your past.

First Offense

  • Up to a $2,000 fine

Second Offense

Your first course of action is to pull over as soon as you can in the safest way possible. Never run from the police as they will catch you, and you will face even worse charges.

After the officer comes to your vehicle, act as polite and courteous as possible. You will be asked to present the officer with your license, registration, and proof of insurance. Inform the officer of their location in a polite manner and slowly retrieve them.

Most officers will ask you if you know why you have been pulled over, because they must justify pulling you over in court. Never admit to the officer why they've pulled you over even if you know. Simply reply with "no sir" or "no ma'am."

Know your rights. You can refuse both a preliminary breathalyzer test as well as the field sobriety test. It is best to refuse these if you even think you'll fail them. All you need to do is state that you're not comfortable doing these tests at the moment and that you would prefer to speak with your attorney before doing so. It is best to assume you're always on video, so maintain a polite attitude.

Depending on if you show other signs of intoxication such as slurred speech, bloodshot eyes, or smelling strongly of alcohol, you can still be arrested. If you are arrested, you will probably be asked to take a blood or breathalyzer test to establish your BAC. Be careful rejecting these requests as this can result in a license suspension. Be aware, though, that if these tests are failed, it can also result in a license suspension. No matter what, your lawyer will fight for you.

If the tests are refused, an officer may be able to obtain a warrant to force you to take them, but this can be a timely process in some cases.
