Driving While Intoxicated in Seguin

The first thing to remember is that running from the police will only make your situation worse. Pull over immediately and be as respectful as possible. Remember that you are probably being filmed on a bodycam.

The officer will approach your window and they will ask for your license, registration, and proof of insurance.  Be sure to let the officer know where you will be reaching for the documents.

police will ask if you are aware of the reason for the traffic stop.  Respectfully say, "No Sir" or "No Ma'am".  The officer is looking to establish probable cause. You don't want to eliminate a potential avenue of defense for your lawyer to pursue on your behalf.

It's within your Constitutional rights to decline participation in both a field sobriety test and a preliminary breathalyzer test.  If you may fail either one, it is wise to refuse these.  Respectfully say you want to speak with your attorney before participating in any tests.  Remember to be as polite and non-aggressive as possible.

You could still be arrested for suspicion of DWI if the police find you have slurred speech, alcohol smell, or bloodshot eyes.  If that happens you could be asked to take a blood or breath test to establish BAC.  Refusal means you face automatic DL suspension, but if you are convicted you will have your license suspended anyway.  In both situations, a lawyer can help you fight the charges.

The police can request a warrant from a judge to compel you to take the test, but this can take some time.

Never speak to police during questioning without your lawyer present, and contact your lawyer at the first chance you have.

Remember that you should never plead guilty when charged with a DUI.  If it is a client's first or third DUI, we can almost always get a reduction or dismissal of charges if you fight the charges.
