Austin, TX – September 15, 2025 – Michael & Associates, a criminal defense law firm based in Austin, Texas, announces that the murder case against Demetrius Jones has been dismissed in Bell County due to lack of evidence and preparedness for trial by the prosecution. However, due to a loophole, Mr. Jones can be re-indicted as soon as tomorrow.
“The D.A. is using slimy tactics and abusing the process by dismissing the case only because they’re not prepared for trial,” said Ben Michael, founder of Michael & Associates. “This is essentially a loophole in the process that the DA is willing to exploit at our client’s expense. Mr. Jones and his family will be paying a high price for Bell County’s lack of preparedness and evidence.”
Due to the lack of evidence, the State was unable to prepare a case that could be proven beyond a reasonable doubt, Michael said. Instead of rightfully dropping the case altogether, the Bell County District Attorney’s Office used the dismissal as a loophole.
The Bell County District Attorney’s Office is refusing to do the right thing,” Michael said, “and instead attempting to manipulate the judicial process to wrongfully charge our client for a case they know they can't prove.”
Mr. Jones has already been held in jail for more than a year because he can’t afford to post bail, and his family members paid to travel from North Carolina to attend his trial.
The dismissal came after the prosecution’s request for a continuance was denied by the court. The prosecution had called no witnesses nor issued any subpoenas in the case. The dismissal is a loophole that allows them to re-indict Mr. Jones on murder charges as soon as tomorrow.
The State was unable to find a single witness that could place our client at the scene of the crime, or any other evidence that had our client even in the general area at the time of the shooting, Michael said.
“Mr. Jones and his family will now have to face additional emotional and financial burdens due to the prosecution’s lack of preparation,” Michael said.

Mr. Jones was scheduled to stand trial on September 15, 2025, on murder charges in connection with the 2021 shooting death of Francine Martinez, a Fort Hood soldier who was shot outside a Killeen nightclub. His trial was initially set for August 4, but it was delayed.
Sgt. Martinez, a soldier stationed at Fort Hood, died from a bullet wound to the head after an altercation at a nightclub in Killeen. The shooting occurred on Sept. 4, 2021, and she was hospitalized for two weeks before her death.
Cpl. Nakealon Keunte Mosley, the father of Sgt. Martinez’s child, was also charged with murder in Sgt. Martinez’s killing. Mosley was found guilty of murder on July 21, 2025. He was sentenced to 60 years in prison on September 9.
