Driving While Intoxicated in Del Valle

Del Valle, in Travis County, TX is subject to Texas law. Any driver who was operating a motor vehicle while having a blood alcohol content (BAC) of 0.08% or higher might be charged with DWI. That number is a measurement of alcohol saturation in your bloodstream.

The amount of time elapsed since you stopped drinking is the main factor in your BAC number, but there are other considerations as well. Mainly, your height, weight, sex, and the strength of the drinks you were consuming. Depending on those factors, each person's BAC will be different.

Never run, that's the first thing to always remember. Running from an officer will make things much worse for you, and the sentences for fleeing are incredibly high. It's nearly impossible to run from police anyway. 

When you are stopped, the officer will ask for your paperwork. Be sure to tell them where it is, then ask them if you can reach for it. Always remain calm and respectful throughout the entire stop, and things will go better for you.

To establish probable cause, you will probably be asked if you know the reason for the traffic stop. Always reply with a respectful, "No sir or ma'am, I don't know why." You don't want to help them build a case against you. 

You have the legal right to decline any test you are asked to take. If you suspect there is a possibility you won't pass the test, it's probably a great idea to decline it. Just inform the officer that you want to speak with a lawyer before undergoing any roadside testing, and respectfully decline to answer questions until after your attorney is present.

If the officer thinks they see signs of intoxication, you might be arrested for suspicion of DWI.  They will almost certainly ask you to take a breathalyzer and a roadside sobriety exam. Refusal will mean a one-year suspension of your license, but failing the tests means that as well. Your lawyer will help you get the charges dismissed or reduced if at all possible.

You can be forced to undergo a blood withdrawal at the station, but it will take time to get a warrant for that. 

Never answer questions without your attorney present, and ask to speak with them as soon as possible.
