Driving While Intoxicated in Pflugerville

If you are stopped by police, pull over immediately. Never run from the police as you will get caught and face even more jail time.

Be respectful to the officer that approaches your vehicle. When they ask to see your license, registration, and proof of insurance be polite. Tell them where the documents are and ask if you can get them. Slowly retrieve them from their location.

If you are asked if you know why you were stopped, your answer should be "no sir" or "no ma'am," because the officer needs probable cause for pulling you over. Don't risk your defense during your court date by admitting to a reason.

It's within your legal rights to refuse both the preliminary breathalyzer test and a field sobriety test. It is good to refuse these if you think you have a possibility of failing them. You should politely inform the officer that you're uncomfortable taking them and would prefer to consult with your attorney before doing so. There is a strong chance you are being recorded, so be respectful.

If the officer decides you look like you have been drinking, you may still be arrested. Once this happens, most people are asked to take a blood or breath test to establish their BAC. Refusing to take the test means you will have your DL suspended, but if you are convicted that is going to happen anyway. Either way, a lawyer can help you fight the result.

The police can obtain a warrant that compels you to take a blood exam, but it is often a slow process.
