Driving While Intoxicated in Florence

Florence, or any other city in Williamson County, adheres to Federal and Texas law for DWI. There is a number you can not be higher than. If you have at or above .08%, you risk arrest for DWI.

The number of beverages you need to reach that point will vary from person to person. Some can drink a lot, some, only one drink is enough to put them over the legal limit. It really depends on their height, weight, and sex. 

In Florence, the penalties vary based on how many offenses you have had.

1st Offense

Start by pulling over safely to the side of the road. Don't run, or you will face a felony charge for fleeing from a LEO.

When the officer comes up to your side, you should ask for permission to reach for any paperwork before you reach around. They want your hands visible unless they have prior notice. 

If they ask whether you understand why you were pulled over, politely tell them that you aren't sure. They want to establish a reason for the stop that can hold up in court as a justifiable stop. Don't help them build that case against you. Always reply you don't know, but do it very respectfully.

You can refuse a test for drunkenness but remain polite through that process. It's your legal right, and it's even a good idea to refuse if you will fail the exam. Just keep in mind that you are probably on body camera and must remain non-aggressive and respectful at all times. 

Things like alcohol on your breath or slurring your words might lead to an arrest for suspicion of DWI. If you are taken into custody, officers might ask you to take a blood test or breathalyzer. Refusal will mean an automatic suspension of your license, but a conviction for DWI means that will happen anyway. Your lawyer can help you fight either situation, whichever occurs.

Once they have you at the station, they can apply for a warrant and force you to submit to a blood exam, but that will take a little time to happen.

Just remember to remain silent during the questioning phase, and ask for your lawyer at the earliest chance you get.
