Charged with a DWI in Georgetown?
A DWI arrest is a very difficult thing to go through, but you aren't alone. We can help.
Any time you operate a car with a blood alcohol saturation over 0.08, you risk arrest for DWI. It is one of Georgetown's most frequent arrests.
Unfortunately, the government of Texas and the Williamson County court system does not turn a blind eye to DWI violators. That's where Michael & Associates steps in.
A DWI Can Be an Expensive Mistake
Just because DWI arrests happen all the time in Georgetown, you might think the punishment isn't severe.
That's incorrect.
DWI convictions carry the following sentences:
First Offense:
- Up to a $2000 fine
- From 3 day to six months in jail
- Loss of driver's license for up to 12 months
Second Offense:
- Up to a $2000 fine
- From one to twelve months in jail
- Loss of your license for up to 2 years
Third Offense:
- Up to a $10,000 fine
- From two to ten years in state prison
- Loss of your license for up to 2 years
- Permanent felony conviction
And that doesn't count the sentence enhancements if you were driving with a child passenger.

Driving While Intoxicated in Georgetown
In Georgetown, Williamson County, and elsewhere in Texas, a blood alcohol content (BAC) of 0.08% or higher means you can be arrested for DWI. That number represents the amount of alcohol in your bloodstream.
Whether you have a BAC above 0.08% depends on the number of drinks consumed, your height and weight, as well as your tolerance, and the amount of time that has passed since your last drink.
In Georgetown, punishment for DWI is based on the number of previous offenses.
1st Offense
- Up to a $2,000 fine
- Up to six months in jail upon conviction, with three days minimum
- Loss of DL for up to 1 year
2nd Offense
- Up to a $4,000 fine
- 30 to 365 days in jail
- Loss of your DL for up to 2 years
3rd Offense
- A $10,000 fine
- From 2 to 10 years in state prison
- Loss of your DL for up to 2 years
Sentence enhancements that will apply if caught driving with a child passenger:
- Increased fines - as much as $10,000
- AS much as 2 years in jail
- six months tacked on to your license revocation
Running from the police is not an option. They will catch you and you will face steep sentences when you are caught. Never run.
When the officer walks up to your window, be cordial. Never be aggressive. Ask if you can reach for your documents when they tell you to. Move slowly and don't make sudden movements.
One thing you will be asked is whether you know the reason for the stop. The answer is always a very respectful no. The officer needs a probable cause for the stop, and admitting to that cause takes away one of the defenses available to you.
You have the ability and right to refuse any test you are ordered to take. Be respectful and tell the officer you simply don't feel comfortable taken the test without your lawyer's approval. Ask to talk with an attorney before consenting to the field sobriety tests.
An officer may arrest you on suspicion of DWI for other reasons, or a judgment call. After the arrest, you will be asked to undergo a blood test or breathalyzer to establish BAC. Refusal means a suspension of your license. That said, a conviction means suspension plus other penalties. Your lawyer can help you fight the charges in either case.
The officer may obtain a warrant to compel you to take the test, but this takes time.
Always remain silent during questioning, and contact an attorney at the first chance you get.
Never plead guilty to a DWI. The stakes are too high and the penalties are too severe for you to give up. Call us today and we promise the best possible defense you can have.
