Driving While Intoxicated in San Marcos

In San Marcos, Hays County, and all of Texas, a blood alcohol content (BAC) of 0.08% or higher means you will be arrested for DWI.  Your BAC is the numerical representation of the alcohol saturation in your bloodstream.

Being over the legal limit is influenced by the number of drinks you had, your weight, and the amount of time that has passed since your last sip. Those are the main contributors to determining your BAC.

San Marcos bases the penalties on the number of previous arrests you had.

1st Offense

  • As much as a $2,000 fine
  • As many as six months in jail, with a 3-day mandatory sentence
  • As much as a year without a license

  • As much as a $4,000 fine
  • From a month to a year incarcerated
  • As much as a two year revocation of your DL

Sentence enhancements for child endangerment will be imposed if there was an underage passenger:

  • Increased fines up to $10,000
  • As much as two years in jail
  • Six more months DL suspension

Running from the police is a mistake. Don't do it. You will be arrested and more penalties will be imposed.

When the officer approaches your car, roll your window down and be polite. Never be aggressive to an officer, and when you are asked to show your documents, be sure to tell them where you are reaching. Above all, always be respectful.

An officer must have probable cause for the stop, so you will be asked if you knew what caused the stop. Always respectfully reply that you don't know. This leaves defense options open down the road.

Always be respectful, since you are certainly being recorded. You have a right to politely decline the tests, and if you expect to fail them, probably should do so. Simply say that you aren't comfortable and ask to speak with your attorney before taking any tests.

The officer might arrest you on suspicion anyway, and ask you to take a test. If you refuse you will lose your license for a year, but if convicted that happens anyway. Your lawyer can help you fight for reinstatement in any case. You can be compelled to take a blood test at the jail, but that warrant will take some time to get.

Never talk to police without your attorney present. Call your lawyer at the earliest opportunity.
