Charge
Possession of a Controlled Substance (Second-Degree Felony)
Location
Atascosa County, 81ST-218TH DISTRICT COURTS
Allegations
The case stemmed from a late night crash. Responding officers searched the vehicle without consent and found a small pill bottle in the center console, its label worn off. The client told them the medication was his from prior treatment. We attacked the legal basis for the search, demanded full lab documentation on the tablets, and compared it to pharmacy records we obtained. Those records undercut the officer's notation about what the pills were and established lawful prescriptions. Faced with those problems, the prosecution dismissed the case.

Possession of Drug Paraphernalia
Location
Atascosa County, Jourdanton Municipal Court
Allegations
During a traffic stop for a minor speeding violation, officers claimed to smell marijuana and searched the vehicle, locating a small pipe and other paraphernalia. Our client received a paraphernalia charge in municipal court. We obtained the reports and scrutinized the basis for the search and the connection of the items to our client, highlighting gaps in the evidence. We also presented mitigation and kept communication focused on a noncriminal resolution. The case was resolved with deferred adjudication.

Driving With a Suspended License
Location
Atascosa County, County Court at Law
Allegations
The client was accused of driving with a suspended license after a minor traffic incident. He had already resolved a citation from the same event and was told there would be no further action, only to see a warrant issued later. We obtained his driving record and suspension history and confirmed the alleged suspension began after the stop, with no proof he had been notified. We compiled the records, highlighted the timeline problems, and pressed the prosecution. The state dismissed the case.
