Allegations
Officers responded to a disturbance at a residence where the client had been drinking. After he opened the door, they moved to detain him and placed him in handcuffs inside the home. While being escorted outside, an officer fell and the client was accused of assaulting a peace officer. We got involved early, demanded the evidence, and documented that any contact occurred after he was cuffed and in the officers’ control. We pressed the state on whether they could prove intentional or knowing contact and causation of injury. Faced with those proof problems, the prosecution dismissed the case.

Despite mutual pushing and the only clear injury being a minor cut to the client, officers arrested the client. We secured the 911 recording, bodycam, and reports, which showed no mention of any back injury at the scene, despite a later claim that an object had been thrown. The complainant also indicated they did not wish to prosecute. We presented the inconsistencies and lack of corroboration to the State, and the case was dismissed.

Allegations
During a heated domestic dispute in a parking area, the argument turned physical and both parties made contact. Our client reported being struck and momentarily blacking out, and when she recovered she had a small knife from her vehicle in her hand. The complainant reported no injuries, and the allegation focused on brandishing. We obtained reports, identified potential bystander video, and documented the chaotic sequence and conflicting accounts. Using those weaknesses, we pressed the prosecutor to reconsider the charge. The case was reduced to a lesser offense, avoiding a felony conviction.

Police were called to a hotel after an argument that followed a day of drinking. Officers noted the complainant’s black eye and arrested our client, who said he acted defensively. The 911 call came from a third party, the complainant later expressed no interest in prosecution, and a child’s reported account conflicted with the fact the child had been asleep. We compiled these credibility problems and highlighted the lack of reliable evidence. After sustained negotiations with the DA, the state dismissed the case.
