A DWI in Spicewood Might be a Life-Changing Event.
Let Us Make it Right.
DWI Penalties in Spicewood are Severe
You aren't the first person to be arrested for DWI in Travis county, but the charges are serious and you need to act toward defending yourself right away.
The prosecution will work hard to sentence you to the traditional guidelines. You need to have a legal team in place to defend against that. A first-time offense might seem like no big deal, but it can mean $2,000 in fines and spending up to six months in jail. A follow-up arrest would mean a $4,000 fine and up to twelve months in jail.
More than two DWI arrests? The felony penalties, in that case, can range from two to ten years in prison, and fines of nearly $10,000.
A conviction also means a driver's license suspension, which will last as much as a year for a first-time offender, and as many as two years for follow-up offenses.
You can also face enhanced sentences for child endangerment and property damage. This can increase your sentence by months in jail, and many thousands of dollars.
Don't Let One DWI Define the Rest of Your Life
One mistake shouldn't define your entire future. You aren't the only person ever arrested for DWI and you won't be the last.
There are a lot of negative outcomes associated with a DWI. One big one is that your license might be suspended before you even go to trial. We can fight to try and stop that. That's not to mention the spike in your insurance premiums, and the criminal record that can show up when trying to find work or rent a home.
The reality is that there is a lot riding on the line after this arrest. Be sure to have someone by your side with experience and the guts to fight for you.

Driving While Intoxicated in Spicewood
Just like any other city in Texas, when you are stopped in Spicewood, or anywhere else in Travis County, anyone operating a motor vehicle with a (BAC) of 0.08% or higher can be charged with DWI. Your BAC is the number that represents the saturation level of alcohol in your system.
Exactly how many drinks it requires to be at or above .08% is different for everyone. Your height, weight, and sex are all contributors. It mostly relies on how long it has been since you took a sip of alcohol.
In Spicewood, it all comes down to whether or not you have any prior convictions.
1st Offense
- As high as a $2,000 fine
- As many as 6 months in jail, with 3 days mandatory
- Losing your license for a year
2nd Offense
- As high as a $4,000 fine
- From 30 to 365 days in jail
- Losing your license for as many as two years
3rd Offense
- $10,000 fine
- 2 to 10 years in prison
- Losing your license for as many as two years
Additional penalties that might apply for having an underage passenger in the motor vehicle:
- Increased fines up to $10,000
- As many as 2 years in jail
- Six extra months of driver's license suspension
The first thing you should keep in mind is that failure to stop for an officer will send you directly to prison. Do not run from the police. You will make things much worse for yourself, and you will not outrun them.
When the officer approaches the vehicle they will ask for your paperwork and license. When you go to retrieve them, ask first and let the officer know where you are reaching. Always be as polite as possible.
The officer might also ask you if you know the reason they initiated the traffic stop. You should politely tell them you don't know why you were stopped. They are looking to establish a reason for the stop, and use that probable cause in court. Don't remove that line of defense from your lawyer's arsenal.
Keep in mind that you are on bodycam, so always be as respectful as possible. You can refuse to take the tests though. If you are asked to take a test you think you might fail, you are within your rights to refuse. You will lose your license for a year if you refuse to take a breathalyzer, but if convicted of DWI you would lose the license anyway. Your lawyer can help you fight for a good outcome in either case.
If the officer who initiated the stop thinks they notice any slurred speech, alcohol on your breath, or bloodshot eyes, you might be detained for suspicion of DWI. Once arrested, They will ask you to submit to a breathalyzer or blood test. Refusal means suspension of your license.
Officers can get a warrant to draw blood, and force you to submit to the drawing, but that will take some time since they need a warrant to do it.
Never answer questions without a lawyer present, and ask to have a conversation with your lawyer as soon as possible.
Alway put up a vigorous defense against a DWI charge. The situation calls for you to mount a speedy and strong defense. You need a tough lawyer by your side.
