Driving While Intoxicated in Conroe

In Conroe, Montgomery County, and the rest of Texas, drivers who are stopped by police with a (BAC) of 0.08% or higher might be charged with driving while intoxicated.  That is a measure of how much of your blood contains alcohol.

The number of beverages that put you at or above a BAC of 0.08% is dependent on several things, including the type of drinks, the time elapsed, your sex, weight, and the tolerance level of your body.

In Conroe, the sentences vary depending on your prior record.

1st Offense

  • As many as a $2,000 fine
  • As many as six months upon conviction, with three days that are mandatory
  • Losing your driver's license for up to a year

2nd Offense

  • As many as a $4,000 fine
  • As many as 1 month to a year in jail

An increase in sentences can be imposed if stopped with an underage passenger, which includes:

Make it easier on yourself and pull over immediately when you are stopped. Running from the officers will only make the penalties worse for you. 

Be sure to let the officer know where you are reaching when they ask you to get your paperwork. Never act aggressively toward an officer. Remember that you are probably being filmed by their bodycam.

Police will ask you if you are aware of why they pulled you over in the first place.  Always reply "No Sir" or "No Ma'am".  Once the case gets to court, any other answer besides no can be spun as probable cause to stop you, and your defense gets much harder.

You have the right to decline the roadside tests and maybe even should if you think you are going to fail them anyway. Be sure to let the officer know that you aren't comfortable taking the tests without speaking to your lawyer first. 

If the officer suspects you have alcohol on your breath, or red eyes they might arrest you anyway. Same thing if you are slurring your speech when talking.  If you are arrested you might be required to take a blood or breath test to establish BAC.  If you still refuse at this time, you will face an automatic suspension of your license. That said, it will be suspended if you are convicted, and your lawyer can help you out in any case. 

You might be forced to take the blood test at a hospital or in jail, but that warrant takes time to get.

Be sure to ask to speak with your lawyer at the earliest opportunity, and never say anything that can incriminate you.

Never accept a simple guilty plea for a DWI. The price for the plea is too high, and you are better off finding a lawyer who can help you negotiate a better outcome.
